2020年开年,黑天鹅事件频发,新型冠状病毒感染肺炎疫情在给国民生命健康造成重重威胁,也给整个市场经济也带来层层阴霾。经过一个延长的春节长假,各地企业开始逐步复工,这场突如其来的疫情,让一些行业遭受冲击,有的行业基本停滞。如何平衡疫情防控和经济生活的恢复,是一个整体系统工程,需要政府部门多维度地展开工作。打好疫情防控战的同时,还要打好中小企业保卫战,在这个过程中,我们律师行业需要做好哪些准备?

PART1 疫情下我们面临哪些风险?

昨天晚上看到会展行业的一份分析报告,显示西安市会展行业预计营业收入损失在100万元上的企业达60%。曲江国际会展(集团)有限公司、西安旭峰丝路会展有限公司,陕西华商国际会展有限公司等重点企业预计损失超过千万元以上。

PART3 张志学教授 北京大学光华管理学院 当不可抗力来袭,能否战胜和跨越,最关键在于人。

此次疫情突然来袭,且跨越春节,又恰逢中国经济结构的变革期,人们面临极大的迷惘,尤其中小企业以及基层工作者和百姓,渴望找到答案和力量,帮助自己跨越这一重大变故。

The sudden outbreak of the epidemic, and the Spring Festival, also coincides with the period of China's economic restructuring, people are facing great confusion, especially small and medium-sized enterprises, grassroots workers and ordinary people, eager to find the answer and strength to help themselves over this major change.

作为组织行为和人力资源的研究者,我的研究对象是组织人、社会人以及人的能动性。对当下面临波及每个人的疫情,我有如下寄语:

(一)作为领导者的人——首席律师

这是一个必须要回望初心的时刻。

你为什么创建这个企业,你为什么在这个岗位,你想完成什么使命,想创造什么价值?

你的使命,会夯实你的战略定力,让你对外协调产业链中的各个环节,对内关爱员工,并为员工赋能,令员工与企业使命同频,共度时艰。

你要比任何人都坚信,中国前进的动能和大趋势不会变。

你要明白,事在人为,既思考创新可能的方向,也思考精细化管理,并将你的信心和有条不紊的安排,传导给每个员工、每个合作伙伴。

此时,你要带着企业活下来,你所有的努力也是在帮助国家对抗疫情:你对企业的自救,正是力所能及地为社会尽一份稳定的责任。

(1) the person acting as the leader -- the chief lawyer

This is a time to look back.

Why did you start this company, why are you in this position, what mission do you want to accomplish, what value do you want to create?

Your mission will strengthen your strategic focus, allow you to coordinate all links in the industry chain externally, care for employees internally, and empower employees, so that employees and the mission of the enterprise with frequency, through difficult times.

You have to believe, more than anyone, that China's momentum and general trend will not change.

You need to understand that it's all about people. Think about possible directions for innovation, think about fine management, and communicate your confidence and organization to every employee and partner.

At this point, you need to survive with the enterprise, and all your efforts are also helping the country to combat the epidemic: your self-help to the enterprise is to do your best to contribute to the stability of society.

(二)作为员工的人——实习律师

这是你要认清大局、并以大局观思考的时刻。

这不是一个劳资谈判和算清账目的时刻。

既已同舟,坚决共济;皮之不存、毛将焉附。面对疫情,每个员工都不可能置身度外。为此,不以批评者的姿态冷眼旁观,不以旁观者的眼光传递负能量,不以弱者的身份等待保护。积极参与公司的调整,接受患难时期可能的利益损失。企业活下来,才有自己的舞台。

也许,这是你原本要辞职的时刻,不建议你此时突然告辞。如果可以,陪伴你的企业走过最艰难的时刻,情义无价。

人心的稳定,也是在为抗击疫情做贡献。

This is not a time for collective bargaining and accounting.

(三)作为社会的人——公民

不传谣,少恐慌,少流动。优化生活方式,用合理的措施保护自己和家人。配合疫情攻坚战,这是每一个公民应尽的义务。

理性判断,坚定信心。人们面临危机时,会高估事件向不好方向发展的概率,面对谣言容易首先选择相信,也倾向从众。事物都有其发展的规律,我们正在经历病毒传播的增长期。万众一心扛过去,需要每一个个体的理性认知。

专注工作,助力企业。疫情当中和疫情过后,确保民生和发展经济是国家持续前进的根本,每个组织人、社会人、每个公民,越是专注工作,就越能帮助国家尽早恢复繁荣。

No rumors, less panic, less flow. Optimize your lifestyle and take reasonable steps to protect yourself and your family. It is the duty of every citizen to cooperate with the epidemic.

Rational judgment, firm confidence. When faced with a crisis, people tend to overestimate the probability that events will develop in a bad direction. They tend to believe rumors first and follow the crowd. Things have their way, and we're experiencing a period of increased viral transmission. To shoulder the past with one heart and one mind requires the rational cognition of each individual.

Focus on work, help the enterprise. During and after the outbreak, ensuring people's livelihood and developing the economy are fundamental to the country's sustained progress. The more focused every organization, every society and every citizen is on their work, the more likely they will be to help the country return to prosperity as soon as possible.

PART4 刘醒律师总结

严峻而复杂的疫情环境下,以90后为主体的新生代员工们,或许是第一次以职场人的身份面对这样全民抗疫的挑战。随着企事业单位陆续复工,或是采取在家办公、远程协作的方式,此时的我们既需要谨慎做好防控工作,也需要回归自身的工作角色。我想结合自身体悟分享一些特殊时期自我管理的应对之策。

Under the severe and complex epidemic environment, the new generation of employees, mainly those born in the 1990s, may be the first time that they face the challenge of nationwide epidemic resistance as professionals. As enterprises and institutions resume work one after another, or adopt the way of working from home, remote collaboration, at this time we need to carefully do the prevention and control work, but also need to return to their own role. I would like to share some coping strategies for self-management in special periods based on my own experience.

第一,科学防范,健康先行。很多云德律师,在单位里是工作的主力,在家庭里也同样是顶梁柱。目前,疫情形势仍然不甚明朗,可能还处在最为艰难的攻坚阶段。作为单位和家庭的双重主力,我们在防控疫情上丝毫不能松懈,从自己做起,科学防范、认真对待,并积极地去提醒和关心身边的家人、同事、朋友——这是我们做好自我管理的最基础一环,也是当下最重要的社会责任。

First, scientific prevention, health first. Many lawyers are the backbone of their work at work and the backbone of their families. As the double main force of the unit and the family, we should not relax in the prevention and control of the epidemic. 第二,重塑工作,孕育创新。复工以来,不少公司采取了远程协作的方式开展工作。不管基于什么样的技术工具来实现,远程协作的最大挑战都不在技术面,而在于观念层面。大多数人都更喜欢循着已有的模式开展工作,而不愿意跳出舒适区迎接挑战。当我们在家远程工作时,可以更好地观察到平日工作中的哪些行为习惯其实是低效率的,哪些工作任务和工作方式可以进一步予以优化,而哪些工作中的合作关系可以加以调整,这些思考其实都有可能是我们日后工作中实现创新的突破点。

第三,调适心境,积极应对。面对不断增长的疫情数字和相关新闻报道,我们都不可避免地会出现诸如悲伤、焦虑、忧心、愤慨、恐慌等各种不同的消极情绪。然而,过多的消极情绪不仅对防控疫情毫无益处,对我们自己应当承担的工作职责和身心健康也都有所伤害。回归工作岗位之后,我们需要适当调整自己的心理和情绪状态。

第四,更新自我,储备未来。疫情终将过去,正处在中坚期的新生代员工们还需要更好地投入到自身和社会的发展进程中去。疫情危中有机,也刺激我们对自己的生活、工作、职业生涯规划进行更为聚焦和冷静的思考。因此,如果你还没有复工,或者你还只是用部分的时间来工作,那就利用余下的时间更新自我的观念与心智模式,为未来自己和组织的发展积累更多能量。
